Just Swim Membership Terms And Conditions
Windermere Manor is the trading name of SBH Windermere
Limited (Company Number: 10730017) registered at Park House, Park House, 10
Penn Road, Beaconsfield, HP9 2LH. When we refer to “we” or “us” or “Just Swim”
in these terms and conditions we are referring to one or more members of Windermere
Manor’s swimming membership scheme, known as ‘Just Swim at Windermere Manor’.
For our Direct Debit members, the initial month's payment
must be made in person at the hotel or via the phone. Subsequent payments are
taken on the monthly anniversary of your sign-up date. If a direct debit is
returned by your bank unpaid, we have the right under BACS regulations to
re-present a request for this payment at any point without notice but within
one month of the original charge. For those joining mid-month, a pro-rata
payment for the balance of the month must be paid in person at Windermere Manor.
We offer a discounted Annual Memberships for customers
wanting to commit for 12 months; this membership cannot be cancelled or
transferred once purchased.
A membership may only be used by the named person who holds
the membership record. Should any other person be found to be using a
membership held by another, the membership will be at risk of being blocked or
further access to facilities denied. Usage will be monitored and if abused, the
membership may be cancelled with no refund provided for any unused part of the
membership.
We reserve the right to terminate a membership at any time
without notice.
Discounted, promotional or concession rates on membership
are excluded from any further discount obtained through a third party offering
or other types of discounted offer.
Swimming Memberships
You can choose how you pay for your membership with us. A
monthly direct debit can be set up with your bank. The payment will come out of
your bank on the 1st working day of each month. Alternatively, you can pay for
12 months in advance and this must be done in person at Windermere Manor or by
calling 01539 445 801. Access to the swimming facilities is available only once
payment has been received.

facilities for the duration of their active membership.

membership plans:

We reserve the right to withdraw or amend member benefits.
Term Time Membership
Members will have access to the swimming pool and changing
facilities for the duration of their active membership only during the school
year, as defined by Westmorland and Furness Council, excluding summer holidays.
The following membership benefits apply for monthly
membership plans:

• 10% discount on accommodation at hotels in the Starboard
Hotels group
All member benefits are subject to availability and
additional terms and conditions.
We reserve the right to withdraw or amend member benefits.
Off-Peak Membership
Members will have access to the swimming pool and changing
facilities for the duration of their active membership only between 9am and 4pm
Monday to Friday.
The following membership benefits apply for monthly
membership plans:

Annual Membership
Members will have access to the swimming pool and changing
facilities for the duration of their active membership.
The following membership benefits apply for annual
membership:
• Voucher to enjoy Afternoon Tea for two people
• Four free guest passes per year
• 20% discount on food & drinks purchased at Windermere
Manor
• 10% discount on accommodation at hotels in the Starboard
Hotels group
All member benefits are subject to availability and

We reserve the right to withdraw or amend member benefits.
Junior Membership
Junior membership plans are for children up to 16 years of
age, and those aged 17-18 in full time education, whose parent or guardian is a
current member of Just Swim at Windermere Manor. Under 16s must be accompanied
by a responsible adult and minimum adult to child swimming ratios must be
adhered to.
IDENTIFICATION
All customers will be provided with a personal membership
card which they will be required to present on each visit to Windermere Manor.
The card remains the property of Windermere Manor. In the event you lose your
card, a replacement will be made available at a nominal charge of £3. The card
may only be used by the person to who, it has been issued.
All customers and members are required to present their
membership card Windermere Manor’s Reception. Your membership card will be
swapped for an electronic keycard giving you access to the swimming facilities.
At the end of your session, members are required to return to Reception to
return their keycard and retrieve their membership card. Members may be refused
entry without a valid card.
As a condition of membership, you will be required to have
your photograph taken and uploaded to Clubright, our membership management
software/app, so we can identify that only the holder of the membership is
accessing the facilities. This is to safeguard all our members in relation to
health and safely and ensure only those members paying for a Membership
subscription are being allowed access. We will store the photograph in
accordance with our Privacy Policy.
A photograph is required upon joining for identification
purposes. Your photograph will not be used in any other way other than for
identification purposes.
Membership cards and App codes are non-transferable and must
only be used by the registered cardholder.
FACILITIES
We reserve the right to withdraw all or any part of our
facilities for short periods of time to carry out routine maintenance. We
reserve the right to change Swimming program timetables from time to time. We
will always strive to give Members advance warning of these times [where
possible] and no refunds will apply in these circumstances provided they occur
no more than 10 times in any 12-month period.
SWIMMING POOL RULES
The pool is unsupervised with no lifeguard on duty and
members and guests are advised to exercise extreme care when using the swimming
pool facilities and swim at their own risk.
The swimming pool measures 10 metres long.
Diving is strictly prohibited.
A plan of the swimming pool which includes details of the
fire alarm system, emergency exit routes and other applicable information is
contained within the reception area of the swimming pool and forms part of
these terms and conditions for the avoidance of doubt.
Any breach of the swimming pool rules, or the terms and
conditions may result in membership being revoked.
Only members and registered hotel guests or those attending
on a Member Guest Pass are permitted to use the pool.
The lifebuoy and hook are for emergency use only.
Water presents a risk of drowning, and injuries can occur
from hitting the hard surrounds, or from misuse of the equipment.
No glass, food or alcohol to be brought into the pool
premises.
We reserve the right to limit use of the pool to a maximum
number of swimmers, including members and hotel guests.
No large inflatable toys, masks, snorkels, flippers or beach
balls to be used in the pool.
For safety and security reasons members must not admit
persons to the pool at any time.
Towels are not provided, and it is the member’s
responsibility to bring this with them.
No outdoor footwear permitted in the swimming area.
If you have a medical condition that may affect your safety,
you must inform the Receptionist immediately upon arrival.
At all times you must conform to the displayed instructions
and any instructions given by staff regarding the use of the swimming pool and
other areas inside or outside of the facilities.
Facilities users are responsible for their own health and
safety and should conduct their activities in a safe manner at all times so as
to not impact on the health and safety of themselves or others when on the
premises.
Admission may be refused to any person who is considered to
pose a danger either to themselves or to others.
In the event of an accident or incident, you must inform a
member of our team immediately.
In the interest of safety and security, please do not
utilise any lockers after the facilities have closed.
To assist in maintaining water quality, showering prior to
the use of the swimming pool is requested.
In the event of an emergency, you must clear the swimming
pool and follow the instructions provided by staff.
Do not swim for at least 48 hours after suffering vomiting
or diarrhoea or swim for 14 days after diarrhoea symptoms have stopped if you
have been told you have cryptosporidium.
CANCELLATION AND FINANCIAL TERMS
An annual membership is offered for a minimum of 12 months
whereby you are committing to a 12 month term and are not able to cancel within
this period. Full payment is due at the time of joining and this is payable in
person at Windermere Manor. Membership is non-refundable and cannot be
transferred.
Monthly membership agreements are offered on a flexible
direct debit membership option with a full calendar month cancellation period.
All monthly direct debit payments are collected on the 1st working day of the
month.
Your membership will commence on the date on which your
first payment is made, after which time you agree to be bound by the terms and
conditions stated in this contract along with the Core Terms and Conditions and
any other applicable terms and conditions.
We calculate your membership in whole calendar months. This
means that the following applies:- Anywhere in these terms and conditions where
we ask you to give notice of one calendar month or more, if you give notice
during a month, we will treat it as if we received it on the first day of the
following month and the notice period will run from that day. The only
exception to this is if we receive notice from you up to and including the
fourth day of a month, we will treat it as if we received it on the first day
of that month and the notice period will run from that day.
We will confirm we have received your notice within 10 days
of receiving it. If you do not receive this confirmation within 10 days, you
must immediately let us know so we can check whether we have received it.
Our contact details are on the website. Cancelling your
direct debit does not mean you have given us notice to end your membership. You
must give us written notice in line with ‘Notice’.
Where a Direct Debit has failed or a member has purported to
have cancelled their Direct Debit without prior agreement, the membership shall
be suspended until payment is received. Any member who falls behind in payments
for more than 1 calendar month will forfeit his/her membership. Upon failure to
make payment, subsequent reinstatement of the membership or any future
membership will be subject to the outstanding membership fees being paid in
full.
In exceptional circumstances, e.g. injury or pregnancy, you
may be allowed to freeze your membership for an agreed period [up to a maximum
of 6 months]. This request must be made in person or by phoning 01539 445 801
stating the reason for the freeze and including supporting medical evidence.
Five working days notice is required to process a freeze in time for the
following month direct debit payment.
Once processed you will receive a confirmation email of
whether the freeze period has been accepted or not - this must be retained as
proof. If medical supporting evidence is provided the freeze fee will be
waived.
We will inform you a minimum of 2 weeks in advance of any
increase in the price of your membership, by email in the first instance. It is
the members responsibility to inform us of any changes to your personal and
contact details including address, telephone number and email address so that
such communications may be made. You can also make these changes directly in
the membership area of your online booking account
We, our subsidiary companies and partners reserve the right
to update and/or amend the terms and conditions as necessary without prior
notice. Members are requested to adhere to the Membership Terms and Conditions
at all times. These may vary from time to time within the centre of choice.
We reserve the right to cancel any membership at our sole
discretion and without paying compensation.
CHANGE OF DETAILS
Should your personal details change, please notify us
immediately. The details we hold for you will be used to communicate
electronically or by letter.
DISRUPTION
Where we have to alter hours of business or change activity
programmes, every attempt will be made to provide advance notice and to
minimise disruption and inconvenience. Compensation in the form of use of pro
rata refunds may be offered where disruption is significant and set to continue
for an extended period.
CONDUCT
We expect our members to behave in a considerate manner and
will not accept any inappropriate behaviour towards other members or our
colleagues. We reserve the right to refuse admission for members behaving in
such a manner.
We will not accept any abusive, threatening and violent
behaviour towards our staff. We will pursue prosecution of anyone who assaults
or intimidates a member of our team and your membership will be revoked.
PERSONAL PROPERTY, INJURY, ILLNESS AND DEATH
You must complete a Pre Activity Readiness Questionnaire
(PARQ) before using the swimming pool.
Medical Conditions - if at any time during your membership
your health changes, you must inform us immediately in writing as it may affect
the type or frequency of activity which you are able to undertake. Equally, if
you feel unwell at any time whilst in Windermere Manor, cease activity
immediately and inform a member of staff.
You should not exercise beyond your own abilities. If you
know or are concerned that you have a medical condition which might interfere
with you exercising safely before you use our facilities you should get advice
from a relevant medical professional and follow that advice.
Subject to the final paragraph of this section, we will not
be liable to you for any loss or damage you may suffer where the same is
attributable to:
• Your own fault
• A third party unconnected with our provision of services
under this agreement; or
• Events which neither we nor our suppliers could have
reasonably foreseen or forestalled even if we had taken all reasonable care.
Nothing in these terms and conditions is intended to limit
or exclude our liability for death or personal injury caused by our negligence
of for fraud, fraudulent misrepresentation or any other liability which cannot
be excluded by law.
We accept no liability for lost or stolen goods whilst on
our premises unless as a direct result of our negligence. Property stored in
lockers is at your own risk. Cars parked in the car park and all contents in
them are your responsibility and we will not accept liability for loss or
damage.
CHANGING ROOMS
Children under the age of 8 may change in the changing room
of their accompanying parent/adult, whether male or female. Memberships are
only available to adults however children are entitled to use the pool while
resident at a hotel guests and accompanied by a responsible adult.
Any articles we find, including items left in lockers at the
end of the day will be removed and kept in storage.
We are required to keep most found items of
clothing/equipment etc for up to four weeks. After this time, we reserve the
right to dispose of these items as we see fit. For hygiene reasons, we do not
keep items of underwear, hairbrushes and combs etc.

LAW AND JURISDICTION
These Terms of Use shall be governed by and construed in
accordance with the laws of England. Disputes arising here from shall be
exclusively subject to the jurisdiction of the courts of England and your use
of the site confirms your agreement to this jurisdiction. Any cause of action
you may have with respect to your use of this site must be commenced within one
(1) year after the claim or cause of action arises.
If any of these Terms of Use is determined to be illegal,
invalid or otherwise unenforceable by reason of the law of any state or country
in which these Terms of Use are intended to be effective, then to the extent to
which that Term or Condition is illegal, invalid or unenforceable, it shall be
severed and deleted from that clause and the remaining Terms of Use shall
survive and continue to be binding and enforceable.
